An intent to return home statement is a documented assertion that even though you or your loved one is not living in your home, or you will be leaving it shortly, you still consider it your primary residence and you intend to live there again if your health allows.

“Intent to Return” protects a Nursing Home Medicaid beneficiary's primary home as an exempt (non-countable) asset. This intent means that if a senior's condition improves and nursing home care is no longer required, the individual intends to move back home.

The state never “takes” your home. However, ownership without proper planning may result in a forced sale if Medicaid demands reimbursement after death. Medicaid may also impose a lien during your lifetime if it is paying for nursing home care.

For example, couples can keep their primary residence, one vehicle, and the value of regular household goods and furnishings without those values counting toward their Medicaid resources. In some cases, medical equipment, jewelry, and other items may also be considered exempt.
