Maryland's law requires children under eight years old to ride in an appropriate child restraint unless they are 4'9″ or taller. Children eight to 16 years old, not riding in a child restraint, must be secured using a seat belt.

The American Academy of Pediatrics recommends parents wait until a child is at least 13 years old, more than 100 pounds and taller than 4 feet 9 inches before he or she sits in the front seat.

Under 8 years old must ride in a car seat or booster seat, used ing to car seat and vehicle manufacturers' instructions, unless the child is 4 feet, 9 inches or taller. Under 2 years old must ride rear-facing. Between 8 and 16 years old must be secured in a car seat, booster seat, or vehicle seat belt. Remember!

On October 1, 2022, Maryland updated its child passenger safety (CPS) law to more closely align with laws in neighboring states. The addition to the law requiring car seat or booster seat use until age 8 requires that children under age two must face the rear of the vehicle in their car seat.

Use a fully upright, forward-facing child seat after the child reaches 1 year old and weighs between 20 and 40 pounds. Read the instructions to learn how to the safety seat and adjust the harness around the child.

Maryland's law does not state a child can't ride in the front seat (except for rear-facing infants in a car with active airbags, this is against instructions, very dangerous and illegal), however, it is strongly recommended by all safety experts that children ride in the back seat until they are teenagers.
