Enforcement of an LTB order Most of the terms and conditions of LTB orders can be enforced through the courts. For example, if the tenant does not move out of the rental unit by the date in the eviction order, the order can be filed with the Court Enforcement Office (also known as the Sheriff's office) to be enforced.

Provide written notice. File an application with the LTB: 7-60 days after providing written notice. Attend LTB hearing: 55.6 days after the application is filed. Receive eviction order: 22.1 days after the first LTB hearing.

An Enforcement Officer will contact the landlord after 11:30 am on the same day to inform the landlord of the date and time the eviction will take place. Typically, the eviction will be scheduled 1- 5 days from this date.

Applications will be scheduled for a hearing within 30 business days. Decisions will be issued within 10 business days of the conclusion of the final hearing.

An appeal of an order may only be made on a question of law. In general, this means a person must believe LTB 's order was not a reasonable interpretation or application of the law. An appeal to Divisional Court must be filed within 30 days of the date the order was issued.

The deadline to appeal an LTB order to the Divisional Court is 30 days after you receive the order. If the 30-day deadline has passed, you can bring a motion to the Divisional Court requesting an extension of time. You do not have to file a Request to Review an Order with the LTB before you appeal to Divisional Court.

On average, the eviction process takes 77.7 days after filing an LTB application. However, you have to provide written notice to your tenant before applying. This can add an extra 7 - 60 days to the process. Overall, the process can take 85 - 138 days after providing the tenant with an eviction notice.
