When a business owes money to another business, the debtor can apply to the County Court for a judgement (CCJ) against the creditor to claim the money. However, it's the Court that will decide whether there is a debt to pay and if there is, it's only then that they will issue a CCJ.

In most cases, where an individual or company is claiming money, the court fee for issuing the claim depends on the amount that is being claimed. This can range anywhere from between £25.00 for a claim of less than £300.00, up to £10,000.00 for claims in excess if £200,000.00.

Currently, there is no minimum amount of debt required before a CCJ can be issued. I received a CCJ for a £10 parking fine.

Send bailiffs to collect payment You can ask the court to send bailiffs to collect the money. The bailiff will ask for payment within 7 days. If the debt is not paid, the bailiff will visit the debtor's home or business to see if anything can be sold to pay the debt.

If you have a county court judgment for a debt and do not pay as the court has ordered, the creditor can apply to the court for a 'warrant of control'. This warrant authorises a county court bailiff to try to take control of your possessions to encourage you to pay what you owe.

You can get this form online from hmctsformfinder.justice.gov.uk You will find information about how to fill in this form on pages 12-14. The smallest amount you can ask the enforcement agent to collect is: one monthly instalment; four weekly instalments; or £50; whichever is greater.

1. If you pay the CCJ in full within a month the details of the CCJ will be completely removed from the court register. You should contact the court to inform them that you have paid. You will be required to send the court proof of payment, and pay a £15 fee.

Bailiffs usually have 12 months to collect a debt, from the date they send their first letter to you - this letter is called a 'notice of enforcement'. They might have longer to collect the debt if coronavirus stopped them from visiting.

The warrant lasts for one year. If the warrant has not been paid or if the enforcement agent has not made a final report within this time, it is no longer valid.

You have to send your form back within 14 days. The court may allow a few extra days for the letter to reach you in the post. But it's very important to send them back as promptly as you can.
