State Human Rights Commission If any person has a grievance that his or her human rights are being violated then he may approach the respective state commission where the alleged act has been committed.

The Commission cannot speak about individual complaints as they are confidential until, and only if, they reach the tribunal stage, even if a complainant or respondent is willing to speak about a complaint.

There are several other avenues for bringing individual complaints to United Nations bodies. Complaints can be submitted to the Human Rights Council's complaint procedure (previously known as the 1503 procedure),2 its special rapporteurs and working groups3 and to the Commission on the Status of Women.

How long does the human rights complaint process take? It depends. The following times are usual, but the process can take longer. It usually takes about one to two months for the Tribunal to decide if can deal with a complaint.

If your rights have been violated, you can report the matter to one of the following bodies: South African Human Rights Commission (SAHRC). Independent Complaints Directorate. If you want to complain about a member of a government department, you should contact the Public Protector.
