How long do you lose your CDL for a failed drug test?

DOT drug and alcohol violations stay on a driver's record for three years, although employers must maintain certain drug and alcohol testing records for at least five years, including positive test results. At the time of my failed drug test, no easily searchable federal database exists for employers.

FMCSA Extends Waiver Period For Certain Pre-Employment Drug Tests From 30 to 90 Days.

If you fail your DOT regulated drug test, DOT regulations require your employer to immediately remove you from performing any DOT safety-sensitive job. There may be other consequences, too, like losing your certification or license.

If the test results in a positive reading, meaning there is drug residue in the body, the results are forwarded to a medical review officer, who reviews the results and looks for any possible valid medical explanation for the results.

If you fail or refuse a pre-employment DOT drug test, it will hinder your ability to get a safety-sensitive job. You will have to complete a Return-to-Duty program by a DOT-qualified Substance Abuse Professional (SAP) before applying for work.

The FMCSA has a minimum random drug-testing requirement of 50 percent of the average number of driver positions, and a minimum of 10 percent for random alcohol testing. In the event either of these percentages is changed by the FMCSA, the change will be published in the Federal Register.

A Substance Abuse Professional (SAP) manages the follow-up testing for up to 5 years, determining how many times an employee is tested, and for what substance. These are completed in addition to other DOT required testing.

DOT Drug and Alcohol Violations stay on your record for 3 years. (Keep in mind; a company may not report the positive or refused test longer than 3 years, but still report that the driver was terminated and is not eligible for rehire due to a company policy violation longer than 3 years.

The Return to Duty SAP Process is required when a DOT regulated safety-sensitive employee is found to be in violation of a DOT mandated drug and/or alcohol test. A violation occurs when an employee fails a mandated DOT drug test for a prohibited substance or refuses to take the test.
