The law requires that the abuser be given formal notice that you have filed for a restraining order. In fact, the judge cannot make any long-term orders or judgments unless the abuser has been properly personally “served” with copies of your forms. You cannot be the one to give these forms to your abuser.

Go to court You will tell the judge why you need a restraining order. You can bring witnesses and evidence to support your case. The other side can bring witnesses and evidence, too.

How to serve your Request for Restraining Order Contact the sheriff. Contact the sheriff in the county where the person you want protection from is located. ... Give the sheriff your court papers. ... Pay a fee, if needed. ... Know your deadline to serve. ... Get paperwork back from the sheriff.

California Penal Code 273.6 makes it a crime to violate a restraining order. They are normally issued in California criminal cases to restrain a defendant from harassing, abusing, stalking, or threatening the alleged victim.

You would simply contact the Clerk of Courts of the county in which you filed and inform the court that you wish to dismiss your Petition requesting a restraining order and ask that the court remove the hearing. The court will also dismiss your Petition if you fail to appear for the hearing.

If the restrained person wasn't served, fill out a Request to Continue Court Hearing and Reissue Temporary Restraining Order (Form DV-115 ) and a Notice of New Hearing and Order on Reissuance (Form DV-116 ) to ask the judge for a new hearing date. Do this before or at your hearing.

If the protected party doesn't show up the judge has nothing to go on and will not extend the order. If the restrained party doesn't show up the judge will have only the protected party's statement to go on and will probably issue the order.

During the hearing, the judge will hears from both parties, and decide whether to extend the restraining order for 5 years. The judge extends a restraining order by signing form DV-130-'Restraining Order after Hearing'.
