Filing a Child Support Case Child support cases are usually started in Family Court in the county where the child lives. There is no filing fee in Family Court. After a child support petition is filed, the other side must be "served" a summons, the petition, and the financial disclosure form.

In New York, there are guidelines for what percentage of the parents' combined gross income should be provided for children. If a couple is supporting one child, 17% of their combined income should go to supporting their child. For two children, 25% of their income; for three children, 29% of their income.

Can Parents Agree To No Child Support? Yes, in some cases if you and your spouse are able to come to an agreement on how you want to handle your child support issue, you may waive the traditional New York child support method.

Either the custodial parent who receives child support can petition Family Court for a modification—usually an increase, or the noncustodial parent who pays child support can petition Family Court for a change--- usually a decrease.
