If you're a separated parent responsible for paying child maintenance and live in England, Scotland or Wales, the Child Maintenance Service can take legal action against you for missing a payment or not paying the amount due. This legal action can force you to pay the child maintenance you owe.

You're normally expected to pay child maintenance until your child is 16, or until they're 20 if they're in school or college full-time studying for: A-levels. Highers, or. equivalent.

Since 1993 child maintenance claims have of course usually been made under the Child Support Act. However, the Act only provides for child support maintenance claims to be made by a parent or carer of the child – it does not include provision for adult children to claim maintenance for themselves.

Child maintenance payments usually continue until the child: turns 16, if they're not in full-time education. turns 20, if they're in full-time education up to and including SCQF level 6. is 16 or over and leaves full-time education.

You can arrange child maintenance directly with each other. This is called making a private or 'family-based' arrangement.

The general rule is that child maintenance payments (as dealt with by the Child Maintenance Service), will cease when the child is aged 16 or when they finish full time secondary education.

They will pay 19% of gross earnings for one child and 27% for two children and 33% for 3 or more children.
