The main difference between an assured shorthold tenancy and an assured tenancy is that the landlord can use section 21 of the Housing Act 1988 to regain possession without giving a reason.

1. You should use this notice only when you wish to inform a prospective tenant or tenants that the tenancy being offered by you is a short assured tenancy under Section 32 of the Housing (Scotland) Act 1988. 2. You must serve the notice on the prospective tenant or tenants before the creation of any tenancy agreement.

A Scottish secure tenant who wishes to assign her/his tenancy has to serve on the landlord a written application to obtain the landlord's consent. [6] The application does not have to follow a specific format but it should clearly state: that the tenant wishes to assign her/his tenancy (not sublet or renounce)

You cannot increase your tenant's rent by more than 3% of their current rent unless you can prove that there has been an increase in certain costs. You can apply to a Rent Officer (part of Rent Service Scotland) to cover up to 50% of your increased costs. This cannot be more than 6% of the existing rent.

You must give your landlord notice in writing that you want the tenancy to end. Your tenancy agreement may state how much notice you need to give. If not, the notice period depends on how long your initial fixed term was for: if your fixed term was for less than four months, you must give 28 days' notice.

ASTs can be: fixed term – often 6 or 12 months. periodic – rolling weekly or monthly.

This is known as the 'termination date' or 'ish'. For many tenants and landlords, it is assumed that on this date their lease will come to an end, the tenant will vacate the premises and the landlord moving forward will be free to do as they wish with the premises.
