The 12-year limit starts at the date of the judgment, which is often the date the creditor went to court. If a court ordered you to pay a creditor money more than 12 years ago, the creditor will not be able to enforce that debt against you. After you obtain a judgment, you file a Request for Writ of Garnishment of Wages (DC-CV-065). To complete the form, you need to know the name and address of the debtor's employer, the amount of the judgment and any additional money owed (such as court costs and interest.)

Wage Garnishment. If the Writ is issued for wages, after the Writ is served on the employer, the employer must withhold wages as directed by the Writ until the judgment is satisfied, or until the court orders the employer to stop withholding.

10 days following the judgment, the creditor becomes a judgment creditor and can begin the wage garnishment process. Under Md. Rule 3-646, the judgment creditor must file a Request for Writ of Garnishment in the case, which is served upon the judgment debtor.

You may request an exemption to the garnishment. You must make your request within 30 days of when the garnishment was served on the bank. Use the form Motion for Release of Property from Levy/Garnishment (DC-CV-036).

A creditor may not garnish more than 25% of your wages per pay period. For individuals earning minimum wage or near minimum wage, you must be left with an amount equal to 30 times the Maryland minimum hourly wage. There is no such limitation on how much a creditor can garnish from a bank account or other asset.

A garnishment proceeding determines whether the debtor has any assets that can be used to pay a judgment. Once a judgment has been entered, the creditor can collect what is owed. Judgments are enforceable in Maryland for 12 years and they can be renewed.

The creditor files a lawsuit and is awarded a judgment. District of Columbia wage garnishment law states that a creditor can't garnish your wages (or acquire any other personal property) before getting a judgment from a court. To get a judgment, the creditor has to file a lawsuit for the unpaid debt.
