When will I get my bond money back? Bonds are only released upon order by a judge, dismissal of the charge, or a finding of not guilty. The bond is returned only to the party posting it.

One way is by paying the set bail amount in full via cash or check. Another way is by signing over ownership rights to property, signing a released on your own recognizance (O.R.) statement that says the defendant will appear in court at a given time or giving a bond in the full amount of the set bail.

Bail bonds fees are regulated by the State Government. In South Carolina, the maximum fee a bondsman can charge is 15% (with a minimum of $25) but because of competition, you should expect to pay about 10% of the total bond amount no matter which bondsman you choose.

How does bail bonds work in South Carolina? A bond court judge sets the defendant's bail amount. A South Carolina bail bondsman posts the bond once the 10% premium is paid by the co-signor. If the defendant doesn't appear in court the co-signor owes the bondsman 100% of the bond.

Documents to satisfy a bond must be submitted to the Criminal Intake window between the hours of 9:00 a.m. and 4:00 p.m., and must be presented in person. If posting money to satisfy a condition of bail, only a cashier's check or money order will be accepted. Cash (over $5,000.00) and personal checks are NOT accepted.

A surety bond is your most standard form of bail bond. A surety bond is almost always given through a bail bonds company (like at The Bail Bonds Doctor). It will cost the defendant 10% of the total bail amount*.

A bond hearing, sometimes referred to as a bail hearing, is usually the first thing that happens after a person is arrested in South Carolina. After the person is booked at the jail, then a bond judge will hear the case and determine whether to let the charged person out, and if so, under what conditions (making bail).
