For each subsequent return and subsequent payment, the amount of withholding is calculated by taking 3 percent of the principal amount included in each payment, or if the seller elects to base the withholding on the gain, 3 percent of the amount of each principal payment which represents gain.

Withholding is required at the rate of 4 percent with respect to the nonresident member's share of taxable income sourced to this state, unless exempted by this regulation or O.C.G.A. § 48-7-129.

To establish the total percentage of taxes withheld for all employees, add the taxes taken out of each individual employee's check and total the result. Determine the amount of gross wages paid during the pay period and divide the total amount of taxes withheld by the result.

You can submit Form 3605 (The Application for Recognition of Exemption) to the Georgia Income Tax Division. Along with the form you will need to submit your Georgia nonprofit's Articles of Incorporation, bylaws, statement of activities in Georgia, and a copy of your Letter of Determination from the IRS.

Georgia does not require registration with the state for a resale certificate.

Georgia requires employers to withhold state income tax from employees' wages and remit the amounts withheld to the Department of Revenue. Georgia residents working outside the state are exempt from Georgia income tax withholding if their compensation is subject to withholding in that state.

O.C.G.A. Section 48-7-128 provides for income tax withholding at a rate of 3 percent on sales or transfers of real property and associated tangible personal property by nonresidents of Georgia.
