An oral deposition of an individual must take place within 75 miles of that person's residence. If the individual lives within 150 miles of the county where the lawsuit is filed, the deposition may be held in that county. A party serving a subpoena for a deposition must pay a witness fee to the person being deposed.

Service is made by personally delivering a copy of the subpoena to the witness named on the subpoena. 4. After the subpoena has been served, the server must complete the Proof of Service located on the reverse side of the Original subpoena.

A subpoena duces tecum (SDT) is a legal court order that orders a person to appear in court during a hearing or trial and bring specific documents or records with them. The term duces tecum is a Latin phrase meaning “you shall bring it with you." The subpoena duces tecum is most commonly used in criminal cases.

Once you receive a subpoena duces tecum, you do not deliver the documents to the attorney that requested them. Rather, you send the documents and/or evidence to the superior court judge presiding over the case. The judge then reviews them and decides if the defense or the prosecutor is entitled to them.

Personal Service: Pursuant to FRCP Rule 45(b)(1) a subpoena must be personally delivered to the person whose attendance is required by the subpoena. A person who serves the subpoena must be at least 18 years of age. A person who serves the subpoena cannot be a party to the proceeding under which the subpoena is issued.

Subpoenas for documents must comply with strict timelines to obtain the documents and some subpoenas seeking personal documents are required to be sent a longer time in advance of the hearing. Subpoenas for documents may be served by mail. If serving by mail add five days to the service time.

Serve the Notice. If it is delivered in person, it must be served at least 10 days before the court date; For a Notice to Attend AND Bring Documents: You must have it served by mail at least 25 days before the court date.

Disobedience to a subpoena, or a refusal to be sworn, or to answer as a witness, or to subscribe an affidavit or deposition when required, may be punished as a contempt by the court issuing the subpoena.
