A deed (such as a TR1) is valid and binding if the essential ingredients of execution as a deed, attestation and delivery as a deed are all present: see section 1 of the Law of Property (Miscellaneous Provisions) Act 1989.

In a residential property transaction, it is usually the seller's solicitor/conveyancer that prepares the TR1 form. This solicitor will complete the form, and the only involvement from the seller themselves will be to provide a signature.

By signing this, the transferor executes, or carries out, the TR1, and allows their conveyancer to create a deed of transfer to transfer of the property to the new owner. If the transfer contains any covenants or declarations which bind the transferee, they must also sign here before the form becomes valid.

The TR1 is the legal document which the parties to the transfer are required to sign in order to affect the transaction, known as the transfer deed. The deed has a number of different panels that you should ensure you understand before signing.

Fill in either a 'transfer of whole of registered title' form, if you're transferring your whole property, or a 'transfer of part of registered title' form if you're only transferring part of your property.
