What is a Conditional Use Permit? A conditional use permit is required for certain land uses listed in the Chesapeake Zoning Ordinance as a "conditional use," requiring special review on a case-by-case basis to determine whether they are appropriate in specified situations.

Conditional Use/Special Use Permit refers to a special permission granted to allow a use that is not permitted by right in the zoning district, but that is generally compatible with the use characteristics of the zoning district and appropriate and compatible with adjacent and nearby uses.

Conditional Use Permits: This is a process by which a specific use is listed as permitted within a zoning district, but still must be reviewed by City Council to determine if the requirements and criteria specified in the ordinance are met.

A conditional use must be specifically listed in the zoning ordinance. Unlike a permitted use, however, a conditional use is not allowed by right at all locations in a district. Rather, it must undergo special review by the plan commission, governing body, or zoning board to determine if it is appropriate for the site.

Special Use Permits are often required for uses that are generally thought of as having external or "spillover" effects that could negatively affect neighboring properties. Included are uses that produce higher than normal levels of noise, light, odor, or activity.

A conditional use permit application is needed when you are requesting a use permitted in specific locations when certain conditions can be met. A CUP requires approval from the Board of Zoning Adjustment or the Planning Commission when requested in conjunction with a zoning change request.

A conditional use permit authorizes a property owner to use property in a way that would otherwise not be allowed under the zoning ordinance. Applications for conditional use permit are reviewed by the Board of Zoning Appeals (BZA), a body of five citizens appointed by the Circuit Court.

The Conditional Use Permit (CUP), sometimes referred to as a "Special Use Permit (SUP)," is a type of use approved for a property by the Board of Supervisors (BOS) with conditions of use accompanying the permitted use.
