Compensation Rates An injured employee is entitled to a compensation rate equal to two-thirds of the average weekly wage (AWW) in New York State for the 52-week period immediately prior to the date of accident. The rate is subject to prescribed maximums and degree of disability.

The Massachusetts Construction Classification Premium Adjustment Program allows for a premium credit to be applied to any experience rated insured with a qualifying average hourly wage for one or more construction classifications.

The New York Experience Rating Plan provides rules regarding the “continuation” or “exclusion” of experience when an entity undergoes a change of ownership. Under the Plan, a change in ownership includes any of the following: Sale, transfer or conveyance of all or a portion of an entity's ownership interest.

The New York Construction Classification Premium Adjustment Program (NYCCPAP) allows premium credits for some employers in the construction industry. These credits exist to recognize the difference in wage rates between employers within the same construction industries in New York.

CCPAP provides premium credits as a specific discount to employers who pay higher than average wages to employees classified within contracting class codes. The CCPAP discount is the percentage decrease that carriers issue to insureds who hold policies that contain contracting classification codes.
