There are two types of leases- a fixed-term and a periodic term lease. A fixed term is a tenancy that is set for a specific amount of time, while a periodic term has no set end date. If you have a fixed-term tenancy, here is the most common way to proceed (may vary by province).

Leases for apartments which are not rent stabilized may be oral or written. To avoid disputes, the parties may wish to enter into a written agreement. A party must sign the lease in order to be bound by its terms. An oral lease for more than one year cannot be legally enforced (General Obligations Law § 5-701).

A lease is an implied or written agreement specifying the conditions under which a lessor accepts to let out a property to be used by a lessee. The agreement promises the lessee use of the property for an agreed length of time while the owner is assured consistent payment over the agreed period.

The rent increase guideline for 2023 is 2.5%. The guideline is based on the Ontario Consumer Price Index, a measure of inflation calculated monthly by Statistics Canada that reflects economic conditions over a 12-month period (June to May).

Periodic tenancies, such as week-to-week, month-to-month and year-to-year leases, can be ended by either the landlord or tenant as long as proper notice is given. A tenant or a landlord is not required to give the other person a reason when giving a Notice of Termination.

Signing a lease means that you are legally obligated to live up to the lease terms, including rent payments and late rent fees. So, if every adult in the property signs the lease and the main tenant fails to pay rent, the landlord can legally pursue the other tenants to pay any late fees or overdue rent.

For rental periods of at least one month, one month after the day notice is given. For rental periods of less than one month, "the day following the expiration of the period beginning on the day on which notice is given and extending for a number of days equal to the number of days in the rent-paying period."

The lease should also be signed by all occupants who are adults, and state whether there is a security deposit and how it may be utilized. It should also state whether the tenant may sublease the apartment.
