You will use USCIS Form I-765: Application for Employment Authorization, to apply for a work permit. Form I-765 is pretty simple. You fill in your name, contact information, and information about your eligibility.

Minors ages 16 and 17 may work four hours per day on any school day and eight hours on any nonschool day or on any day preceding a nonschool day up to 48 hours per week. WEE students and personal attendants may work more than four hours on a school day, but never more than eight hours.

A: Work permits take an average of 5 business days to process. Q: If a student has more than one job, is one work permit enough to cover all positions held? A: No, a separate Work Permit must be issued for each employer. The total number of hours worked for all employers must not exceed the number allowed by law.

It usually takes 48 hours to process the Work Permit.

A work permit may be issue to only minors between the ages of 12 and 18 years of age (EC Section 49111). A child under school age is probably being employed in the entertainment industry.

Except in limited circumstances defined in law and summarized in the Child Labor Law Booklet, all minors under 18 years of age employed in the state of California must have a permit to work.

In most cases it is a two-step process, the minor along with the parent/guardian and employer fill out the B1-1 form and submit to the school local to the minor's address. The school district reviews the B1-1 form and issues the B1-4 (Work Permit).
