A federal fiduciary is a person or legal entity authorized by VA to serve as payee of VA benefits for a beneficiary unable to manage his or her financial affairs.

How much does a VA fiduciary get paid? The fiduciary is allowed to charge a fee of up to 4% of the amount the VA pays to the beneficiary. If the VA has deemed a veteran to be incompetent and unable to manage their veterans benefits, the VA will carry out a field examination to determine the most appropriate fiduciary.

Additional, responsibilities of the fiduciary include, but are not limited to the following: Utilizing the funds for the daily needs (e.g., food, clothing, housing, medical expenses, and personal items) of the beneficiary and his/her recognized dependents.

A decision can also be made after 60 days once the RO analyzes the evidence the veteran submitted or after a hearing has taken place.

Upon the death of a beneficiary who has a valid will or heirs, the fiduciary must hold the remaining funds under management in trust for the deceased beneficiary's estate until the will is probated or heirs are ascertained, and disburse the funds ing to applicable state law.

VA's Fiduciary Program was established to protect Veterans and other beneficiaries who, due to injury, disease, or due to age, are unable to manage their financial affairs.
