Arizona Revised Statute Section 25-320 is the foundation of the Arizona child support laws. That statute provides that child support can be ordered in any action for dissolution of marriage, legal separation, or action upon child support between parents, married or unmarried.

Retroactive Support vs Back Child Support Under Arizona Statute 25-320, the state law declares that the judge can enforce a previous date for when child support payments start. Your ex-partner may have to pay you for up to three (3) years prior to any child custody order of filing.

Generally, a child support obligation continues until the child is emancipated by turning 18 or graduating from high school. In Arizona, an action for back child support must be brought within three years from emancipation.

In Arizona, you can file for any service at any time, including filing for back child support as long as paternity has been established. The Division of Child Support Services (DCSS) is where you can receive assistance to file for back child support.

Arizona's child support formula considers each parent's income and how much each pays toward children's health insurance, child care and education. It also considers the number of children in the case and their ages, as well as parenting time (counted ing to Arizona's unique method, described below).

The court orders a flat percentage of 25% of the non-custodial parent's income to be paid in child support to the custodial parent.

The Navajo Nation Child Support Guidelines are based on the Income Shares Model. The Income Shares Model is predicated on the concept that the child should receive the same proportion of parental income that he or she would have received if the parents lived together.

If you are in a situation where the other parent has not been paying the child support and the child has reached the age of 18, you still have the legal right to pursue an action against them to retrieve the unpaid money. Call the Family Law Team at (480) 467-4348 to discuss your case today.
