If the tenant has not moved out in the allotted timeframe, the landlord can request a warrant of restitution. This is the first step in the eviction process, as it directs the sheriff to allow the landlord to take possession the property. It allows the landlord to remove the tenant's possession off of the property.

If the tenant does not leave, then the landlord can seek a “warrant of restitution.” This allows the landlord to make a plan with the constable or sheriff to evict the tenant and remove the tenant's possessions. A landlord must request a warrant of restitution within 60 days of the judgment.

A warrant of restitution is a type of court order. It tells the sheriff to go to a property and carry out an eviction. The landlord must wait four business days after receiving a judgment for possession before they can file for a warrant of restitution.

Upon the written request of the holder of a judgment awarding possession of property, the clerk shall issue a writ directing the sheriff to place that party in possession of the property.

How Long Does an Eviction Stay on Your Record? An eviction itself doesn't appear on your credit report. However, any unpaid rent and fees could be sent to collections and remain on your credit report for seven years from the original delinquency date.

Within five working days, the landlord can file for a court order for the evic- tion, called a “warrant of restitution,” and arrange for a sheriff to oversee the eviction. You may appeal an eviction judgment.

To begin the process of eviction, the landlord requests a Warrant of Restitution. In a failure to pay rent case, the Landlord must make the request within 60 days of judgment or the expiration of any stay of execution. The eviction cannot take place on a Sunday or holiday.

It takes about 5 to 30 days from the issuance of the Notice to Quit, depending on the reason for eviction and the lease agreement.

Going to Court in Maryland The district court will issue a summons to the tenant, informing the tenant of the eviction case and the date for the trial or hearing before a judge. If the landlord is successful, the tenant will have four days to move out of the rental unit after the trial has ended.
