"Under the Last Month Rule, if an individual is eligible on the first day of the last month of the tax year (December 1 for most taxpayers), he or she is considered an eligible individual for the entire year.

For the last-month rule, the testing period begins with the last month of your tax year and ends on the last day of the 12th month following that month (for example, December 1, 2021, through December 31, 2022).

The last-month rule requires you to be eligible for an HSA on the first day of the last month of the tax year. For most taxpayers, that day is December 1. It does not matter if you were ineligible for any or all of the other months.

If, during the tax year, you are the beneficiary of two or more HSAs or you are a beneficiary of an HSA and you have your own HSA, you must complete a separate Form 8889 for each HSA.

If you do not stop HSA contributions at least six months before Medicare enrollment, you may incur a tax penalty. If you require counseling around HSAs, consult a tax professional.

Last-month rule. If you are an eligible individual on the first day of the last month of your tax year (December 1 for most taxpayers), you are considered to be an eligible individual for the entire year, so long as you remain an eligible individual during the testing period as discussed below.
