LTL (less than truckload) freight claims must be filed within 9 months of the delivery date. Carriers have 30 days to acknowledge the claim and 120 days from the date of acknowledgment to come to terms. Concealed damage or shortage claims must have notification given to the carrier within 5 business days of delivery.

Freight claim can be defined as a legal demand by the consignee or a shipper to a carrier for financial reimbursements. This happens if the shipment has been lost or damaged. Freight claim is also knowns as cargo claims, transportation claims or shipping claims.

What types of damage claims are there? Visible damage — The damage is readily apparent. Shortage — Only part of the shipment is received. Concealed damage — This is damage or shortage discovered after the delivery driver has left and the shipment is un-palletized and/or shipping containers or boxes are opened.

Who should I file a Freight claim against? Shipping claims are filed against the carrier. If there is more than one carrier, a claim is filed against either the originating carrier or the delivering carrier.

Filing a Freight Claim Proof of delivery. The original BOL, or bill of lading. Explanation of loss or damage. Dollar amount being claimed. A copy of the original vendor invoice showing. the value of the goods being transported. Photos of the goods and packaging, if damaged.

Who should I file a Freight claim against? Shipping claims are filed against the carrier. If there is more than one carrier, a claim is filed against either the originating carrier or the delivering carrier.

Pay, Decline, or Make a Firm Settlement Offer (49 CFR § 370.9). Motor carriers are required to pay, decline, or make a firm settlement offer in writing to the claimant within 120 days after receipt of the claim.

Legally, a shipper has nine months from the date of delivery (pickup, if lost) to provide a formal cargo claim to the carrier. This is a fancy way of saying the shipper must: salvage, discount, or repair the commodity.
