In 1996, California enacted "Megan's Law," which provides the public with photographs and descriptive information on serious sex offenders residing in California who have been convicted of committing sex crimes and are required to register their whereabouts with local law enforcement.

This is done by submitting a Megan's Law Exclusion Form to the California Department of Justice. A person can ask for removal from the sex offender registry website if they were convicted of: Sexual battery by restraint (PC 243.4a), or. Annoying or molesting a child (PC 647.6)

California only requires landlords to give written notice about the registered sex offender database website to tenants when the rental period begins. Thus, the tenants must access the Megan's Law website individually to search for sex offender neighbors.

The (CAR) has a Megan's Law Database Disclosure Form that must be signed by all parties in a Real Estate Transaction. The Disclosure Form is to advise Buyers/Tenants that it is their responsibility to research the offender database, should they desire.

The disclosures are given by the sellers to the buyers. They cover everything about the house itself and the area surrounding the house. One of these documents will be Megan's Law disclosure. It lets the buyers know where they can access the information regarding sexual predators.

This new law went into effect on January 1st of 2022 and has changed the state's sex offender registry for good. Certain individuals who are registered sex offenders can now file a petition to be removed from the list if they meet certain eligibility criteria.

The registered sexual offender must report in-person to a Registration / Verification site within three business days to report the new information to the Pennsylvania State Police. The registered sexual offender must also register the new information with sexual offender registry in the other state/jurisdiction.
