In Civil law, it refers to combining of two or more actions involving the same parties or issues into a single action through court order. When the cases involve similar or related questions to be decided, the court may consolidate the cases in order to promote the efficient use of judicial resources.

Courts usually consolidate cases to speed up the trial process and to eliminate duplicative trials involving the same parties, issues, and evidence.

A motion to consolidate is a motion which seeks to combine two cases into one proceeding. It may be granted if the cases involve common questions of law or fact to be resolved.

Consolidating judgments means that all the debts are added together and treated like one debt. This will make your finances less confusing because you will only be making one payment. To consolidate judgments, you will need to make a motion in court.

When separate actions are filed in the same jurisdiction based on the same incident, the cases are usually first deemed to be “related.” Relatedness is an entirely separate concept from consolidation of actions. As a party becomes aware of a related case, the party should file and serve a Notice of Related Case.

(a) Consolidation. When actions involve a common question of law or fact or a common subject matter, the court, on motion or on its own initiative, may order a joint hearing or trial or consolidation of any or all of the claims, issues, or actions.

Hall held that civil actions consolidated under Federal Rule of Civil Procedure 42(a) retain their separate identities, so that a final decision in one action is immediately appealable by the losing party, even if other actions in the consolidated proceeding remain.

(a) Consolidation. If actions before the court involve a common question of law or fact, the court may: (1) join for hearing or trial any or all matters at issue in the actions; (2) consolidate the actions; or. (3) issue any other orders to avoid unnecessary cost or delay.
