This certificate is to be used when the purchaser intends to resell the tangible personal property or service in the regular course of busi- ness.

If tangible personal property, including fuel, gas, steam or electric- ity is purchased and that purchase qualifies for an exemption from the sales or use tax, the purchaser may present an exempt use certificate to the vendor to certify that the property will be used in an exempt manner.

Small Business Energy Exemption To qualify, businesses need to generate a gross income of less than $1 million in the previous calendar year, and also reasonably expect to have a gross income of less than $1 million this calendar year.

In order to claim an exemption from sales tax on purchases in MA, a copy of the Certificate of Exemption (Form ST-2) must be presented to the vendor at the time of purchase. In addition, Form ST-5 must be completed.

To claim the exemption, the buyer or their agent must provide the vendor with: A signed copy of Sales Tax Exempt Purchaser Certificate (Form ST-5) or Contractor's Sales Tax Exempt Purchase Certificate (Form ST-5C), and. A copy of the organization's Certificate of Exemption (Form ST-2) issued by DOR.

Procedure. In order for a purchase to be exempt from Massachusetts tax, an authorized federal employee must present to the vendor the GSA card with appropriate identification at the time of purchase. A Certificate of Exemption (Form ST-2) and a Sales Tax Exempt Purchaser Certificate (Form ST-5) are not required.

The exempt government organization is encouraged to submit to the vendor a properly completed Sales Tax Exempt Purchaser Certificate (Form ST-5) with a copy of its Form ST-2 attached.
