A provisional patent application (PPA) is a document issued by the U.S. Patent and Trademark Office (USPTO) that helps protect a new invention from being copied during the 12-month period before a formal patent application is filed.

In addition to the description, the provisional application must include: all drawings necessary to understand the invention; the names of all inventors; the appropriate filing fee (approximately $125 for individual inventors); and. a cover sheet that identifies the invention.

While the use of an application data sheet is not always required (see MPEP §§ 601.05(a) and 601.05(b)), the Office prefers its use in all applications to help facilitate the electronic capturing of important data.

The provision on 37 CFR 1.53(c)(1) requires that all provisional applications are to be filed with a cover sheet. This can be an application data sheet or a cover letter stating that the document is a provisional application.

File Formats Accepted Finally, ZIP files are accepted for submission of international applications (ONLY when using PCT-SAFE). USPTO supports Adobe PDF standards versions 1.1 to 1.6 for PDF creation. Adobe Reader 7.0. 9 or higher is required to use EFS-Web Fillable forms.

However, the Patent Office does require you to file the ADS or application data sheet in order to claim priority back to a prior-filed patent application such as a provisional or a parent nonprovisional application.

This web-based eTerminal Disclaimer can be filled out completely online through web- screens and no EFS-Web fillable forms are required. eTerminal Disclaimers are auto- processed and approved immediately upon submission if the request meets all of the requirements.
