The McKinney-Vento Act requires local educational agencies (LEAs) to ensure that each homeless child and youth has equal access to the same free, appropriate public education, including a public preschool education, as other children and youth.

The McKinney-Vento Act ensures educational rights and protections for homeless children and youth. Various living arrangements meet the McKinney- Vento definition of homeless, thereby qualifying the child or youth as eligible for services under the Act.

Subtitle VII-B of The McKinney-Vento Homeless Assistance Act authorizes the federal Education for Homeless Children and Youth (EHCY) Program and is the primary piece of federal legislation related to the education of children and youth experiencing homelessness.
