An intent to return home statement is a documented assertion that even though you or your loved one is not living in your home, or you will be leaving it shortly, you still consider it your primary residence and you intend to live there again if your health allows.

When the Medicaid applicant signs an “intent to return home” statement, the Medicaid Agency will not force the sale of the home. The home will not be counted for eligibility purposes, but the Medicaid Agency will place a lien on the home.

The state never “takes” your home. However, ownership without proper planning may result in a forced sale if Medicaid demands reimbursement after death. Medicaid may also impose a lien during your lifetime if it is paying for nursing home care.

In addition to higher income allowances, New York Medicaid also increased the amount of financial resources an eligible applicant or benefit recipient can keep. The 2023 resource allowance level was increased to $30,182 for an individual and $40,821 per couple.

For example, couples can keep their primary residence, one vehicle, and the value of regular household goods and furnishings without those values counting toward their Medicaid resources. In some cases, medical equipment, jewelry, and other items may also be considered exempt.
