Arbitrators are paid for their time to preside over the matter by the day or hour. The least expensive arbitrators usually charge $150 an hour, while the most expensive might charge $400-$500 an hour or more depending on their area of expertise. Arbitrators are not always lawyers, and are usually not judges.

Tit. 22 § 137.0 - Scope of program. This Part establishes the New York State Fee Dispute Resolution Program, which provides for the informal and expeditious resolution of fee disputes between attorneys and clients through arbitration and mediation.

Filing Fee $100 for disputes over $1,000 and up to and including $5,000. $250 for disputes over $5,000 and up to and including $10,000. $750 for disputes over $10,000.

If the parties choose a private arbitrator, they will be required to pay the arbitrator's regular hourly rate and other charges.

Arbitration is often resolved much more quickly than court proceedings, so attorney fees are reduced. Also, there are lower costs in preparing for the arbitration than there are in preparing for a jury trial. For binding arbitration, there are limited opportunities for appeal.
