The annual Burning Law bans open-air burning before 4 p.m. within 300 feet of the woods or dry grass. However, burning is still allowed after 4 p.m. with proper precautions, and open burnings are permitted if they are more than 300 feet away from the woods or flammable grass.

Outdoor burning is permitted between September 1st and April 30th. Burn permits are not required in Fulton County, however burning should be limited to leaves, sticks, or that which falls naturally from the trees. A garden hose should also be kept near the burn area.

During the forest fire seasons, March 1 to May 31 and October 1 to December 31, no open burning may be conducted between the hours of 7:00 a.m. and 5:00 p.m. unless a burning permit is obtained from the Division of Forestry and the proper permit fees paid.

Open-air burning is not permitted in urban areas in the City of Burlington. Open-air burning is a fire hazard and poses a risk to nearby homes, sheds, decks and landscape material. It is only allowed in designated rural areas.

During any fire season, a person may set on fire or cause to be set on fire any forest land, or any grass, grain, stubble, slash, debris, or other inflammable materials only between 5 p.m. and 7 a.m., at which time the fire must be extinguished.
