This is done by filing a “Notice of Non-payment and Request for Transfer” form with the district court clerk's office. After you submit the form, the judgment will be entered on the district court's judgment docket and you may seek to collect the judgment by garnishment, execution or other sanctioned process.

The claim must be filed on the form designated by the court. The original claim must be sworn to and signed in the presence of the Court Clerk or a Notary Public. Upon receipt of the form and fees, the Clerk will file the claim and fill in the claim number.

For example, the Washington statute of limitations is three years for oral contracts, six years for written contracts, and three years for personal injury and property damage cases. If you don't file within the proper period, you lose your right to sue.

Any individual may bring a small claims suit for recovery of money only for an amount up to $10,000. Petitioner must be a "natural person" (i.e. a human individual). In all other cases, the jurisdictional amount is still $5,000. Only the person who is owed the money can file the small claim case.

After filling out the Notice of Small Claim form: Get at least two copies of the form. ... Give the court clerk the original. Pay the clerk a small fee to file the claim. ... Sign the form in front of the clerk, if your county requires it. Mail a copy of the Notice of Small Claim or have it delivered in person to Defendant.

The summons shall contain the date it was deposited in the mail and shall require the defendant to appear and answer the complaint within 90 days from the date of mailing. Service under this subsection has the same jurisdictional effect as service by publication.

The filing fee will be either $35 or $50 depending on whether the county in which you file the lawsuit supports a dispute resolution center. You may have some additional fees payable to the sheriff or process server to have the Notice of Small Claims served on the defendant.
