32Short assured tenancies (1)A short assured tenancy is an assured tenancy— (a)which is for a term of not less than six months; and. (b)in respect of which a notice is served as mentioned in subsection (2) below.

This notice informs you as tenant that your landlord intends to apply to the Sheriff for an Order for possession of the house at the address in Part 1, which is currently occupied by you.

Notice under the Housing (Scotland) Act 1998 to inform a prospective tenant that they have a short assured tenancy. An AT5 form must be issued to tenants before they sign their lease to create a short assured tenancy. The system for private lets changed in December 2017.

1. You should use this notice only when you wish to inform a prospective tenant or tenants that the tenancy being offered by you is a short assured tenancy under Section 32 of the Housing (Scotland) Act 1988. 2. You must serve the notice on the prospective tenant or tenants before the creation of any tenancy agreement.

A short assured tenancy has an end date, but your landlord has to follow the right process if they want you to leave. Otherwise, your tenancy is automatically renewed. If your landlord did not give you a valid AT5 form before you moved in, you'll have an assured tenancy instead.

Your tenant has to give you at least 28 days' notice in writing if they want to end the tenancy (unless they ask for shorter notice and you agree in writing). The notice period will begin on the day you get the notice from your tenant, and ends 28 days after that date.

Notice of proceedings (AT6) This can be sent at the same time as the notice to quit, or at a later date. A notice of proceedings is a document telling you that your landlord wants to start legal proceedings to get their property back. It should be on a special form called an AT6.

This is a legal document which tells your tenant they must leave your property. If the tenancy agreement started before 1 December 2017 they do not have a private residential tenancy and you should not use this notice (unless the tenancy was converted to a private residential tenancy after 1 December 2017).
