A South Carolina notary public is authorized to perform the following notarial acts (SCC §26-1-90): Take acknowledgments. Administer oaths and affirmations. Execute attestations and jurats.

Each family member needs his or her signature notarized. Can I be the notary for them? No. If a notary public is a party to a transaction, or has a direct or indirect financial (or other beneficial) interest in the transaction, no matter how small, the notary must decline the notarization.

A notary public's jurisdiction extends throughout the State of South Carolina, but does not extend beyond its borders (§26-1-80). Jurisdiction is limited to the physical borders of South Carolina and notarial acts cannot be performed outside of the state.

A Notary Public may change the name on their commission by sending the Secretary of State a name change application, your current certificate of commission, a rider or endorsement from the insurance agency or surety, and a $20.00 filing fee.

Signers in different locations or 3+ signers Once the first signer has notarized their document they can send the notarized document to the second signer. The second signer can then upload the notarized document and proceed through the process for their notarization.

The application must be signed with pen and ink and the signature of the applicant must be acknowledged by a person authorized to administer oaths (§26-1-40). The date of your signature and the date of the notarization must match. You cannot notarize your own signature on the application or at any other time.

By law, you must notify our office within 30 days of a name and signature change. A copy of an acceptable ID that shows your new name is required. To file a name or signature change, log in using your notary ID and password and select “Change my name” under Actions on your Summary page.
