Form ST-809 New York State and Local Sales and Use Tax Return for Part-Quarterly (Monthly) Filers Revised 3/23. Page 1. April 2023.

Who must file the 1127 tax return? Any New York City employee who was a nonresident of the City (the five NYC boroughs) during any part of a particular tax year must file an 1127 return. In most cases, if you received an 1127.2 statement from your employer, you must file an 1127 return.

For most people this is straightforward: the primary residence where you live is both your state of domicile and the state in which you are a resident for tax purposes. However, you can still be considered a resident of New York State for income tax purposes even if you are not domiciled in the state.

If you have a valid Certificate of Authority, you may use Form ST-121 to purchase, rent, or lease tangible personal property or services exempt from tax to the extent indicated in these instructions. Complete all required entries on the form and give it to the seller.

Sales and use tax rates in New York State reflect a combined statewide rate of 4%, plus the local rate in effect in the jurisdiction (city, county, or school district) where the sale or other transaction or use occurs.
