You must file Form IT-201, Resident Income Tax Return, if you were a New York State resident for the entire year.

Who must file the 1127 tax return? Any New York City employee who was a nonresident of the City (the five NYC boroughs) during any part of a particular tax year must file an 1127 return. In most cases, if you received an 1127.2 statement from your employer, you must file an 1127 return.

Innocent spouse relief can relieve you from paying additional taxes if your spouse understated taxes due on your joint tax return and you didn't know about the errors. Innocent spouse relief is only for taxes due on your spouse's income from employment or self-employment.

If you are requesting relief for more than one tax year, you only need to file one Form IT-285. There are three types of relief: innocent spouse relief, separation of liability, and equitable relief. An explanation of each type of relief is given on page 2. See Publication 89, Innocent Spouse Relief, for more details.

If the joint return was for a tax year beginning on or after January 1, 1999, you must file Form IT-285 to request relief from the liability and related penalty and interest. If you are requesting relief for more than one tax year, you only need to file one Form IT-285.

You do not qualify for innocent spouse relief, separation of liability relief, or relief from liability for tax attributable to an item of community income. You have an understated tax or unpaid tax. You and your spouse (or former spouse) did not transfer assets to one another as a part of a fraudulent scheme.

Purpose of Form A taxpayer may use Form 285 to authorize the department to release confidential information to the taxpayer's Appointee. The department may have to disclose confidential information to fully discuss tax issues with, or respond to tax questions by, the Appointee.
