The Home Office can provide housing and financial support to a person who becomes appeal rights exhausted (ARE) when their asylum claim is unsuccessful if they do not have accommodation and/ or cannot afford to meet their essential living needs.

The Act includes provisions for reform of the arrangements for detaining persons under immigration legislation. It introduces a system of bail hearings and a statutory presumption in favour of bail for persons detained for immigration purposes and provides for certain bail hearings to be heard by magistrates.

Section 96 of the Nationality, Immigration and Asylum Act 2002 removes the right of appeal against a refusal of a protection or human rights claim that could have been made earlier. Section 96 is intended to prevent claimants raising matters at the last minute to frustrate removal.

(1)A local authority may provide support for asylum-seekers and their dependants (if any) in ance with arrangements made by the Secretary of State under section 95. (a)in one or more of the ways mentioned in section 96(1) and (2);

Asylum support is provided by the Home Office while your asylum claim is being considered (this means while you are waiting for a decision), or after your claim for asylum has been refused.

The Act includes provisions for reform of the arrangements for detaining persons under immigration legislation. It introduces a system of bail hearings and a statutory presumption in favour of bail for persons detained for immigration purposes and provides for certain bail hearings to be heard by magistrates.

Section 96 support is an additional payment option for asylum seekers who experience 'exceptional' circumstances or need and are currently in receipt of Section 95 support.

A person may be subject to immigration bail when their immigration status means that they are liable to be detained. This was formerly known as 'temporary admission' and may apply, for example, to a person who is a visa overstayer or an appeal rights exhausted (ARE) asylum seeker.
