Personal data that is a record of your intentions in negotiations with an individual is exempt from the right of access. This only applies to the extent that complying with a SAR would be likely to prejudice the negotiations. An individual makes a claim to his insurance company.

Are emails included in a subject access request? Any data held about a person, including information in emails, provided the requester is identifiable and the information relates to them as an individual, will usually constitute personal data for the purposes of a subject access request.

You have the right to ask an organisation whether or not they are using or storing your personal information. You can also ask them for copies of your personal information, verbally or in writing. This is called the right of access and is commonly known as making a subject access request or SAR.

The right of access only applies to the individual's personal data contained in the email. This means you may need to disclose some or all of the email to comply with the SAR. Just because the contents of the email are about a business matter, this does not mean that it is not the individual's personal data.

You can make a subject access request to find out: what personal information an organisation holds about you; how they are using it; who they are sharing it with; and. where they got your data from.

You can make a subject access request verbally, but we recommend you put it in writing if possible because this gives you a record of your request....They can: structure your request; prompt you to include necessary details and supporting documents; and. let you know the best contact point at the organisation.

What should I include? A clear label for your request (use 'subject access request' as your email subject line or a heading for your letter) The date of your request. Your name. Any other information used by the organisation to help prove to them that you are who you say you are. Your current contact details.
