You have to file your lawsuit in the right country and the right court. Most often, you will sue where the injury occurred. However, jurisdiction may depend on location and who you are suing. If companies with strong ties to the United States are involved, you may be able to sue in the United States.

You should contact your country's embassy or consulate and ask about their procedures for filing lawsuits against people who are citizens of other countries. This process can take longer than just asking at home because there is more red tape involved with international matters than there would be domestic.

If you live in the European Union and want to claim against a German party, there are two judicial procedures to help you, the „European Small Claims Procedure“ and the „European Payment Order“. If someone owes you money and is not willing to pay it back, you can also try the German "Mahnverfahren".

If you would like to sue somebody, you have to file a written complaint with the responsible court. The responsible court is usually the court where the defendant lives. With the complaint you have to pay the court fees in advance. The court fees are calculated upon the amount of money you are seeking by the complaint.

In France, the competent court for small claims is the Tribunal d'Instance (“Court of first Instance”, the District Court).

The Regulation (EC) No 861/2007 established a European small claims procedure for cross-border disputes where the claim does not exceed 5,000 euros. This procedure intends to improve access to justice by simplifying cross-border small claims litigation and reducing costs.

The ESCP is predominantly a written procedure that deals with claims under €5,000 arising in cross-border disputes. Its main advantage is that it provides for the enforcement of decisions in any of the member states without the present need to go through the formal mutual recognition of judgements (exequatur).
