What can be determined is how long an offender must serve before the parole board will consider their case. If the offender was sentenced to five years for committing a 3(g) offense they must serve half of their sentence, two and a half years, before the parole board can consider them for parole.

How long do offenders spend in prison? Those placed in immediate custody by the courts go straight to jail. For about 90% of such sentences, an automatic release is granted half-way through the sentence. The offender is then on licence for the remainder of it.

The Maximum Sentence Date is the date on which the offender will have served every day of their sentence. For example if an offender was sentenced to five years the Maximum Sentence Date will be calculated by determining the date on which the offender has credit for five years.

The Board of Pardons and Paroles decides which eligible offenders to release on parole or discretionary mandatory supervision, and under what conditions. The Board uses research-based Parole Guidelines to assess each offender's likelihood for a successful parole against the risk to society.

Texas law says that offenders for non-3g crimes become parole-eligible when they have served actual calendar time plus good conduct time equaling 25 percent of the sentence or 15 years (the lesser of the two).

The following inmates are not eligible for parole: Prisoners with a death sentence. Prisoners with a sentence of life without parole. Prisoners convicted of continuous sexual abuse of a young child or children.

There is no limit to how long a person can be on parole. An offender who is released on parole in Texas will be on parole until their sentence is complete.
