The Building Act 1984 empowers and obliges local authorities to enforce the building regulations in their areas. These powers include a right of entry into buildings and powers of prosecution and enforcement in relation to non-compliant building work, dangerous structures and demolitions.

Regulation 3 of the Building Regulations defines 'building work'. Building work includes: a. the or extension of a building b. the provision or extension of a controlled service or fitting c. the material alteration of a building or a controlled service or fitting.

Prosecution is possible up to two years after the completion of the offending work.

The local authority has a general duty to see that building work complies with the building regulations, unless it is under the control of an approved inspector. Only local authorities have the power to enforce standards if things go wrong.
