An appeal is not another trial but an opportunity for the defendant to try to raise specific errors that might have occurred at trial. A common appeal is that a decision from the judge was incorrect – such as whether to suppress certain evidence or to impose a certain sentence.

Law of limitation:- The Limitation Act, 1963, however, provides the period of filing up appeals. It states that the appeals against a decree or order can be filed in a High Court within ninety days and in any other court in thirty days from the date of the decree or order appealed against.

Under the Federal Rules of Civil Procedure, a party can move to appeal the case within an additional 30-day window after the initial 30 days expired, but will have to persuade the court that there was “excusable neglect” or “good cause” which prevented the party from filing the notice of appeal on time.

In a civil case, either party may appeal to a higher court. In a criminal case, only the defendant has a right to an appeal in most states. (Some states give the prosecution a limited right to appeal to determine certain points of law.

What is an appeal? An appeal is when someone who loses a case in a trial court asks a higher court (the appellate court) to review the trial court's decision.

Answer: For civil cases you have 30 days from the date that the order was entered to file a Notice of Appeal. If the U.S. Government is a party to the action, the time for filing a Notice of Appeal is 60 days from the date the order was entered.

After a trial, there are several types of motions that can be filed to address possible trial errors. The most common type of post-trial motion is a Motion for Reconsideration in which you are asking the judge to reconsider his/her ruling and change one specific part of the court order or the court's overall ruling.

About the appeals process You must file a Notice of Appeal with both the Indiana Court of Appeals Clerk to begin the appeals process. The filing fee is $250. If you need copies of any portion of the trial court file, make your request within the Notice of Appeal.
