You must file Form 8857 no later than 6 months before the expiration of the period of limitations on assessment (including extensions) against your spouse or former spouse for the tax year for which you are requesting relief.

Form 8857 should be filed with your return on eFile.com as soon as possible to eliminate any inaccurate dues in the form of tax liability that should belong to the other spouse. The IRS may send you a notice or propose an increase to your tax liability, to which you should file the form.

Taxpayers file Form 8857 to request relief from tax liability, plus related penalties and interest, when they believe only their spouse or former spouse should be held responsible for all or part of the tax.

There are two types of tax relief for spouses: Injured spouse relief lets you reclaim money taken from your tax refund to cover your spouse's debts. Innocent spouse relief relieves you from paying additional federal income tax owed by your spouse due to errors on a joint tax return.

Form 8379 can be e-filed. An innocent spouse (Form 8857, Request for Innocent Spouse Relief) is asking the IRS not to hold him or her liable for tax resulting from actions of the other spouse in a joint return. Form 8857 is not transmitted with an e-filed return, but must be paper-filed separately.

Alternatively, you can fax the form and attachments to the IRS at 855-233-8558. For a list of private delivery services you can use to meet the “timely mailing as timely filing” rule for filing Form 8857 by the deadline, go to IRS.gov/PDS. Write your name and social security number (SSN) on any attachments.
