In Minnesota, which follows eastern – Riparian Rights -- water law, groundwater, lakes and streams are defined in law as “waters of the state” and we all share the right to use them and to enjoy the benefits they provide to ecosystems.

A DNR water appropriation permit is required to pump water or allow to flow by gravity from a lake, wetland, watercourse, spring, ditch, gravel pit, quarry, natural or artificial pond, or well; to irrigate gardens and lawns if the amount exceeds 10,000 gallons per day, or one million gallons per year.

"A lake would be sufficiently large and deep to create wave action that would sweep at least part of the shore free of vegetation," he said. So it's not just the size of the water, it's the motion of the ocean, if you will. By comparison, a pond is a basin surrounded by tall vegetation. Often there is no shoreline.

Area of sand cannot measure more than 50-feet along your shoreline, or one-half the entire width of your shoreline (whichever is less). Area of sand is no more than 10-feet waterward of the ordinary high water level.

The Water Appropriation Permit Program exists to balance competing management objectives that include both development and protection of Minnesota's water resources. A water use permit from the DNR is required for all users withdrawing more than 10,000 gallons of water per day or 1 million gallons per year.

The 2013 Minnesota Legislature amended both the statute that regulates water use (appropriation) permits, administered by the Minnesota Department of Natural Resources (DNR) (Minnesota Statutes, section 103G.

For types 1, 2, 6, 7 and 8, a pond can “typically” be dug without a permit – as long as the result is less than 6.5 feet deep, among other requirements, which are available on the “Wildlife Ponds” fact sheet on the county website.
