AFFIDAVIT OF DENIAL OF PATERNITY (DOP) (Form VSB 908B): If a married or formerly married mother claims that her husband or ex-husband is not the genetic father of the child and the genetic father would like to acknowledge paternity, the husband may complete a voluntary Denial of Paternity (DOP).

This is done by filing a Petition to Establish Parentage, Determine Custody and Time-Sharing and Assess Child Support. The statutes that give the court “jurisdiction” (authority to do something) in cases where parents of children were not married are 40-11A-101 to 40-11A-903 NMSA 1978.

If the mother was unmarried at the time of the child's birth and no other name is listed on the certificate of birth as the father, the biological father's name may be added to the birth certificate by filing an Acknowledgment of Paternity Statement form.

If the child is under six years old, this prolonged period is three months. If the child is older than six years, than a parent cannot be gone more than six months or else he has abandoned his child.

Filing an affidavit with the New Mexico Department of Health. This is enough to establish paternity for purposes of state law, even if the parents aren't married to each other.

If the child's mother and the man claiming to be the child's father don't agree about paternity testing, then either party may file a case with the court at any time before the child's 21st birthday. In these circumstances, a New Mexico court may require paternity testing.

Establishing paternity in New Mexico means that a court or a government agency has determined an individual to be a child's father. However, paternity can also be established voluntarily by the parents. This can be as simple as signing an affidavit and filing it with the Department of Health.
