A hearing typically begins with procedural information from the judge. The parent who filed the request for custody orders (or their attorney) has the first opportunity to speak and present evidence, followed by the other parent (or attorney). Both parents are sworn in as witnesses before the judge asks them questions.

A motion is a request to the court or judge to decide a particular issue in a case. When the other parties or attorneys contest the motion, a contested motion hearing is necessary to resolve the matter.

At the final hearing, the Judge will decide about the contact and residency arrangements for the children. The final hearing is usually a formality to make clear the final decisions about the court order that outlines the requirements for the arrangements for the children.

You'll be given time to ask questions and give evidence in your case. If you have a solicitor or barrister, they'll ask questions for you. If you're giving evidence during the hearing you will be asked to swear an oath or make a legally binding promise (known as an affirmation) that your evidence will be true.

When the court lists a hearing for an application it will notify the applicant of the time, date and place for the hearing and may at the same time give directions as to the filing of evidence (CPR PD 23A, paras 2.2–2.5). The notification from the court is known as the notice of hearing.

The process typically happens via documents rather than court appearances, and the court usually needs at least a year to make a decision. If more than 30 days have passed since an order was issued, parents have two options: a motion to set aside a judgment, or a motion for relief of judgment.

The hearing must be at least 28 days after the date of notice. If the court gives notice of the date of the hearing on 1 October, the earliest date for the hearing is 30 October. (iii) Particulars of claim must be served within 14 days of service of the claim form.

The hearing allows the judge to review each spouse's requests. The judge will then sign the divorce decree to make the divorce final. Unless there was family violence, the judge can't finalize a divorce at the hearing until 60 days after the petition for divorce was filed.
