WHAT IS A CONDITIONAL USE PERMIT? ACONDITIONAL USE PERMIT (CUP) allows a city or county to consider special uses which may be essential or. desirable to a particular community, but which are not allowed as a matter of right within a zoning district, through a public hearing process.

A conditional use must be specifically listed in the zoning ordinance. Unlike a permitted use, however, a conditional use is not allowed by right at all locations in a district. Rather, it must undergo special review by the plan commission, governing body, or zoning board to determine if it is appropriate for the site.

A Conditional Use Permit is required for some land uses that under most circumstances would be allowed with appropriate restrictions. Such uses must be compatible with the existing neighborhood and conform to the county's comprehensive land use plan.

A conditional use permit only authorizes the use specifically described in the permit. The use may not be changed or expanded and is strictly subject to the conditions specified in the permit.

A conditional use permit is a property right that “runs with the land.” That is, it attaches to and benefits the land and is not limited to a particular landowner (Minn. Stat. § 462.3595, subd. 3).

A CUP cannot be transferred to a new property – if you move your business or operation, you'll need to choose property that has the proper zoning or apply for another conditional use permit.

A Conditional Use Permit is required for a change in use or the expansion of a legal non-conforming use if the proposed changes would increase the size, square footage, seating capacity or parking of existing permitted improvements by 20% or more.
