The 10/10 Rule Following a dissolution of marriage, a former spouse who has at least 10 years of marriage overlapping 10 years of creditable military service may apply for direct payment of the retirement from the Defense Finance & Accounting Service (DFAS). 10 U.S. Code § 1408(d)(2).

How Long Does a Military Spouse Receive Pay After Divorce? If your former spouse is entitled to a portion of your military retirement pay, then they will continue to receive this payment until one of you passes away. If you die before your ex, then their benefits will stop.

If the spouses have at least 10 years of marriage overlapping the military service, DFAS will pay the former spouse's share directly to the former spouse. The retirement is still an asset that can be divided with fewer than 10 years of overlap, but in such cases the retiree will be required to send payment each month.

To qualify for direct payment, the USFSPA requires that a former spouse must have been married to the member during at least 10 years of the member's service creditable for retired pay. Under the USFSPA no more than 50 percent of a member's disposable retired pay will be sent as a direct payment.

The law only allows division of “disposable retired pay,” which means the full military pension minus certain deductions. VA disability compensation is not a part of the military pension, and a court, therefore, cannot divide it between divorcing spouses as it could divide, for example, bank accounts and IRAs.

Are former spouses of military retirees automatically entitled to a portion of the retirees' retired pay? No, there is no Federal law that automatically entitles a former spouse to a portion of a member's military retired pay.
