There are no set rules for determining child support in families that have joint custody because the circumstances of each situation are unique. The amount of time spent with each parent will typically affect the calculation, along with the incomes of both parents.

No over-length briefs may be submitted without advance permission to do so. Briefs may not be submitted after the time fixed by this rule or by court order, including the pretrial order, without leave of court, which may be applied for ex parte.

The court may, in order to protect the best interests of the children, conduct the custody hearing in a family action prior to a final hearing of the entire family action. As part of the custody hearing, the court may on its own motion or at the request of a litigant conduct an in camera interview with the child(ren).

In family actions in which the court finds that either the custody of children or parenting time issues, or both, are a genuine and substantial issue, the court shall refer the case to mediation in ance with the provisions of R. 1:40-5.

While the guidelines provide a rebuttable presumption of child support for parents whose combined net incomes fall within the guideline amounts, they do not address couples with net incomes exceeding the maximum income contemplated by the guidelines.

Don't assume, however, that a 50/50 custody arrangement automatically negates child support. If one parent earns a higher salary than the other, the court may still order that parent to pay child support so the child has the same quality of life in both households.

The New Jersey Child Support Guidelines through Appendix IX-B define gross income as all earned and unearned income that is recurring or will increase the income available to the recipient over an extended period of time.

New Jersey Court Rule 5:6B mandates that child support orders in New Jersey must be adjusted every two years to reflect the cost of living, as established by the Consumer Price Index. These changes are referred to as “Cost of Living Adjustments” or simply COLA.

The percentages of combined income per child are as follows: 17 percent for one child. 25 percent for two children. 29 percent for three children.
